The Agency for Health Care Administration shall distinguish private duty nursing services and attendant nursing care services from skilled home health services in its Medicaid provider enrollment process. As of October 1, 2021, the agency may not require a home health agency that does not provide Medicaid-skilled home health services and provides only attendant nursing care services or private duty nursing services, or both, to meet the requirements of Medicare certification or its accreditation equivalents for participation in the Medicaid program.
