For purposes of this chapter:
(1) “Advisory Committee” means the Committee established under this chapter.
(2) “Behavioral health facility” means a facility that is primarily engaged in providing, by or under the supervision of a doctor of medicine or osteopathy, psychiatric services for the diagnosis and treatment of persons with a mental illness.
(3) “Correctional healthcare facility” means any healthcare facility operated at any Department of Correction facility in this State.
(4) “Department” means the Department of Health and Social Services.
(5) “Dialysis center” means a facility approved to furnish outpatient dialysis services directly to end stage renal disease (ESRD) patients. Outpatient dialysis includes:
a. Staff-assisted dialysis (dialysis performed by the staff of the facility); and
b. Self-dialysis (dialysis performed with little or no professional assistance by an ESRD patient who has completed an appropriate course of training). ESRD is that stage of renal impairment that appears irreversible and permanent and requires a regular course of dialysis or kidney transplantation to maintain life.
(6) “Freestanding surgical center” means a facility licensed under Chapter 1 of this title.
(7) “Healthcare associated infection” means a localized or systemic condition:
a. That results from adverse reaction to the presence of an infectious agent or agents or its toxin or toxins; and
b. That was not present or incubating at the time of admission to the healthcare facility.
(8) “Healthcare facility” means a correctional healthcare facility, dialysis center, freestanding surgical center, hospital, long-term care facility, or behavioral health facility.
(9) “Hospital” means an acute care healthcare facility licensed under Chapter 10 of this title.
(10) “Long-term care facility” means a nursing facility or intermediate care facility for persons with intellectual disabilities licensed under Chapter 11 of this title.
(11) “Public report” means the report provided to the healthcare facilities and the public by the Department as set forth in this chapter.
