District of Columbia Code Division VII. Property. § 42-3111. Drug-, Firearm-, or Prostitution-Related Nuisance Abatement Fund.

(a) There is established as a special fund the Drug-, Firearm-, or Prostitution-Related Nuisance Abatement Fund (“Fund”), which shall be administered by the Mayor in accordance with subsection (b) of this section.

(a-1) The revenue deposited into the Fund shall consist of damages collected in cases brought pursuant to this chapter;  provided, that the balance in the Fund shall not exceed $2 million at any time and any excess above that amount shall be transferred to the unassigned fund balance of the General Fund of the District of Columbia.

(b) The funds in the Fund shall be available for use by the Attorney General to carry out the enforcement of this chapter, including all costs reasonably related to prosecuting cases and conducting investigations pursuant to this chapter.  The Attorney General may also use the funds in the Fund to enforce Chapter 36A of this title, including all costs reasonably related to prosecuting and conducting investigations of housing receivership cases.

(c) Disbursements made from the Fund to the Office of Attorney General or other appropriate agency shall be used to supplement and not supplant the Office of the Attorney General's appropriated operating budget.

(d) Any money remaining available in the Fund at the end of a fiscal year, as determined by the Chief Financial Officer in the fiscal year-end close, shall be transferred to the unassigned fund balance of the General Fund of the District of Columbia as part of the fiscal year-end close.
