District of Columbia Code Division VII. Property. § 42-3021. Definitions.

<Text of section applicable upon the date of inclusion of its fiscal effect in an approved budget and financial plan.>

For purposes of this chapter, the term:

(1) “Area median income” means the area median income of the Washington Metropolitan Statistical Area as set forth in the periodic calculation provided by the U.S.  Department of Housing and Urban Development.

(2) “Department” means the Department of Housing and Community Development.

(3) “Eligible homeowner” means an owner or owners who:

(A) Owns a single-family residential property;

(B) Has a household income that is 80% of area median income or less;

(C) Has resided in the single-family residential property as a primary residence for at least 3 years;

(D) Is current on all mortgage payments for the last 3 months;

(E) Is current on all District and federal taxes;  provided, that an owner who has not defaulted on a real property tax payment plan entered into pursuant to § 47-811.05 and remains current on real property taxes that come due shall be considered current on District real property taxes for purposes of determining eligibility under this paragraph;  and

(F) Possesses current homeowners insurance.

(4) “Single-family residential property” shall have the same meaning as set forth in § 47-803(6).
