(a) By January 2026, DOEE shall establish an Electric Vehicle Charging Incentive Program (“Program”) to provide assistance, including incentives for the operation, installation, or upgrade of, or to assess the need for, electric vehicle charging infrastructure located in the District.
(b) DOEE may work with the electric company, as that term is defined in § 34-207, to develop assistance offered by the Program; provided, that any ratepayer-funded assistance offered by the electric company under the Program shall be approved by the Public Service Commission.
(c) The Mayor, pursuant to subchapter I of Chapter 5 of Title 2 [§ 2-501 et seq.], may issue rules to implement the provisions of this section. The proposed rules shall be submitted to the Council for a 45-day period of review, excluding Saturdays, Sundays, legal holidays, and days of Council recess. If the Council does not approve or disapprove the proposed rules, in whole or in part, by resolution within the 45-day review period, the proposed rules shall be deemed approved.
