(1) The functions of the division comprise all administrative functions of the state in relation to the administration of articles 70 to 82 of this title 8. The division and the office of director of the division are type 2 entities, as defined in section 24-1-105, and exercise the powers and perform the duties and functions prescribed under articles 70 to 82 of this title 8 under the direction and supervision of the executive director of the department of labor and employment. Any vacancy in the office of director of the division is filled in the manner provided by law.
(2) The division may accept and expend moneys from gifts, grants, donations, and other nongovernmental contributions for the purposes for which the division is authorized.
(3) The division shall contribute education and workforce data beginning in the 2025-26 state fiscal year, as necessary, to the Colorado statewide longitudinal data system consistent with the governance practices established by the Colorado statewide longitudinal data system governing board pursuant to section 24-37.5-125(4).
