For the purpose of aiding in the protection and development of the waters of the state and for the benefit of the present and future inhabitants of the state, there is created a Colorado water conservation board with the powers and duties set out in this article 60. The board is an agency of the state, and the functions it is to perform, as set out in this article 60, are governmental functions for the welfare and benefit of the state and its inhabitants. The Colorado water conservation board is a division of the department of natural resources and is a type 1 entity, as defined in section 24-1-105.
