(1) For the 2008-09 budget year and for each budget year thereafter, each approved facility school shall submit its pupil enrollment to the department and receive funding from the department in accordance with the provisions of section 22-54-129.
(2)(a) For the 2009-10 budget year, through the 2021-22 budget year, the department shall annually withhold two percent of the amount payable to each approved facility school. For the 2022-23 budget year, the department shall withhold four percent of the amount payable to each approved facility school. The amount withheld shall be allocated to the office to offset the costs incurred by the office and the facility schools board in implementing this part 4.
(b) For the 2023-24 budget year, and for each budget year thereafter, funding for the administration of the office is provided through a separate appropriation.
(3) In state fiscal year 2021-22 only, and within available appropriations, the department shall distribute supplemental payments to facility schools approved by the department as of October 1, 2021. The supplemental payments must be above and beyond the current daily per pupil revenue rate as established for the 2021-22 state fiscal year. The department shall determine the method through which the supplemental payments are distributed to all approved facility schools and shall ensure that the supplemental payments made pursuant to this subsection (3) are paid to the approved facility school prior to June 30, 2022.
(4) In state fiscal year 2022-23 only, and within available appropriations, the department shall distribute supplemental payments to approved facility schools that are approved by the department as of October 1, 2022. The supplemental payments must be above and beyond the current daily per pupil revenue rate as established for the 2022-23 state fiscal year. The department shall determine the method through which the supplemental payments are distributed to all approved facility schools and shall ensure that the supplemental payments made pursuant to this subsection (4) are paid to the approved facility schools prior to June 30, 2023.
