(1) There is hereby created a division of banking within the department of regulatory agencies. The division shall be charged with functions provided by law. Whenever any law of this state refers to the banking department, said law shall be construed as referring to the division of banking.
(2) The administrative head of the division is the commissioner of banking, who is the state bank commissioner appointed and serving as provided by law, and the deputies and employees of the commissioner are deputies and employees of the division of banking. The commissioner, at the time of appointment, must be experienced in the theory and practice of the business and regulation of financial services institutions under the jurisdiction of the banking board.
(3) This article 102 is repealed, effective September 1, 2033. Before the repeal, this article 102 is scheduled for review in accordance with section 24-34-104.
