(a) Supporting information.
(1) When the Forest Service files its preliminary conditions with FERC, it must include a rationale for each condition, explaining why the Forest Service deems the condition necessary for the adequate protection and utilization of the affected NFS lands, and an index to the Forest Service's administrative record that identifies all documents relied upon.
(2) If any of the documents relied upon are not already in the license proceeding record, the Forest Service must:
(i) File them with FERC at the time it files its preliminary conditions; and
(ii) Provide copies to the license applicant.
(b) Service. The Forest Service will serve copies of its preliminary conditions on each license party.
