Editorial Note: The DATES paragraph of the final rule at 85 FR 62016-01, published Oct. 1, 2020, provides:
This rule is effective on September 7, 2017 1 because a Court vacated the rule that became effective on that date (82 FR 36934). The vacated rule repealed the original publication of this rule (81 FR 43338). The attempted postponement of the effectiveness of the original publication (82 FR 11823) was also vacated by Court order. The combined effect of the original publication, vacated postponement, and vacated repeal rule is that industry must comply with these regulations for production occurring from and after January 1, 2017.
