(a) On or before July 1, 2023, and annually thereafter, the department shall submit a request for a federal waiver to waive the provisions of Section 273.9(b) of Title 7 of the Code of Federal Regulations, or any other federal law, regulation, or guidance, to exclude the basic allowance for housing provided to uniformed service members pursuant to Section 403 of Title 37 of the United States Code from countable income in the determination of eligibility and benefit level for purposes of receiving CalFresh benefits.
(b) Upon federal approval of the waiver, the department, in consultation with the County Welfare Directors Association of California, advocates for CalFresh recipients, and the Military Department, shall issue an all-county letter instructing counties on updated eligibility requirements and benefit calculations for uniformed service members receiving a basic allowance for housing.
