Any person who maliciously digs up, cuts down, injures or destroys any shade or ornamental
tree on any county highway, unless such tree is considered an obstruction by the road
commissioner and is removed under his direction, is liable to a penalty of one hundred
dollars, recoverable as provided in section 1496, for each such tree.
