Selected group disability insurance is that form of disability insurance conforming
to the following conditions:
(a) Written under individual policies
(1) Issued to not less than three employees of the federal or state government, or
of any federal or state agency, political subdivision or district, or of any public,
governmental, or municipal corporation, or of any unit, agency, or department thereof,
or of any corporation, copartnership or individual employer; or
(2) Issued to not less than three members of any association, which shall have been
in existence for at least two years, having a constitution and bylaws and formed and
continuously maintained in good faith for purposes other than that of obtaining insurance;
(3) For amounts of insurance based upon individual selection by the insured employee
or member, as the case may be.
(b) Notwithstanding the provisions of Section 10401 insurers may be permitted to file (for use in connection with selected group disability
insurance), rate schedules that reflect a differential from the rates charged for
identical policies issued on the individual basis, provided they do not make or permit
any discrimination between selected groups.
