(a) The Governor may appoint the person, who, on the date of the transfer of the California State Police Division to the Department of the California Highway Patrol, is serving as the Chief of the California State Police Division, to the position of Deputy Chief within the Department of the California Highway Patrol for a period of 12 months. The position has the powers of a peace officer as defined in Section 830.2 of the Penal Code. The authorization for this position of Deputy Chief expires 12 months after the effective date of the Governor's appointment. The Governor shall notify the Secretary of State of the effective date of that appointment.
(b) This section shall remain in effect only until 12 months after the effective date of the appointment described in subdivision (a) and as of that date is repealed.
