Notwithstanding any other law, a city or town may not require the owner of a property located in the city's or town's municipal planning area to connect to the city's or town's sewer system if the property is located in a county island as defined in § 11-251.12 unless the department of environmental quality has determined that connection is necessary to abate an environmental nuisance as defined in title 49, chapter 1, article 3 1 or to eliminate a threat to a water quality standard established pursuant to title 49, chapter 2, article 2. 2 The property rights of property owners in this state are of statewide concern. This section preempts all local laws, ordinances and charter provisions to the contrary.
