A. The department of child safety and the department of education shall adopt a clear, written arbitration process for prompt resolution of disputes between the department of child safety, local educational agencies and the department of education regarding the arrangement for and funding of a child's transportation to a school determined to be in the best interest of the child pursuant to § 8-530.04.
B. The arbitration process shall include provisions to ensure transportation to the school of origin or current educational placement if a prior best interest determination has been made until the dispute is resolved.
C. A decision resolving a dispute pursuant to this section shall be made within ten business days after receipt of the dispute.
