A. A person entitled to withdraw groundwater in an active management area or a person entitled to recover stored water pursuant to § 45-834.01 may deepen an existing well or construct a replacement well at approximately the same location. The director shall by rule define what constitutes a replacement well, including the distance from the original well site that is deemed to be the same location for a replacement well.
B. Prior to deepening an existing well or constructing a replacement well at approximately the same location, the person shall file a notice of intention to drill pursuant to § 45-596 and provide the director with any other information as the director may by rules require.
