In the absence of proceedings under § 44-1901 or article 8 of this chapter 1 for denial, suspension or revocation of the registration of the securities, or with the consent of the commission after the institution of such proceedings, an applicant may at any time amend or withdraw an application for registration, prospectus, financial statement or other exhibit filed with the commission. Any document withdrawn shall be marked as withdrawn but retained among the records of the commission.
