A. The office of the state fire marshal shall implement this article pursuant to the implementation and substance of the New York fire safety standards for cigarettes in section 156-c of the New York executive law and part 429 of title 19 of the New York Code of Rules and Regulations.
B. The office of the state fire marshal may adopt rules to enforce this article.
C. As authorized pursuant to § 42-3151, the department of revenue in the regular course of conducting inspections of distributors and retailers may inspect cigarettes to determine whether the cigarettes are marked as required by § 37-1404. If the cigarettes are not marked as required, the department of revenue shall notify the office of the state fire marshal.
D. An agent of the department of revenue who is also a law enforcement agent or investigator may conduct inspections pursuant to § 37-1405, subsection G.
E. For the purpose of this section, “cigarette”, “distributor” and “retailer” have the same meanings prescribed in § 42-3001.
