A. The nursing care institution resident protection revolving fund is established. The fund consists of monies received from civil penalties collected by the director pursuant to § 36-431.01, subsection D. 1
B. The director shall use monies in the fund for the purposes prescribed in § 36-431.01, subsection F, subject to legislative appropriation.
C. Monies in the fund are exempt from the provisions of § 35-190 relating to the lapsing of appropriations.
