A. The public health emergencies fund is established consisting of legislative appropriations. The director shall administer the fund. Monies in the fund are continuously appropriated and may be spent for public health emergency responses of this state following a state of emergency declaration by the governor. Monies in the fund are exempt from the provisions of § 35-190 relating to the lapsing of appropriations.
B. On or before September 1 of each year, the department shall report any expenditures from the fund to the joint legislative budget committee.
