A. A person who is required to pay fees pursuant to § 3-468.04 and who fails to pay the fee within the time required by § 3-468.04 shall be assessed a penalty of ten per cent of the amount of the total fee and two per cent interest per month on the unpaid balance. The penalty and interest shall be paid to the council. The person may request a hearing before the council to dispute or determine the amount of any fee, penalty or interest imposed.
B. The council shall hold a hearing if requested. After the hearing the council shall enter its order determining the amount of any fee, penalty or interest. The person shall pay the fee, penalty and interest assessed within ten days after notice of the council's decision.
C. A person who knowingly fails to pay or remit any monies due or collected as required in this article is guilty of a class 2 misdemeanor. 1
