A. The emergency management assistance compact and Arizona mutual aid compact revolving fund is established consisting of monies appropriated by the legislature and monies received as reimbursement for costs incurred by this state and any supporting partners of this state, while rendering aid as prescribed in § 26-309 or 26-402, that respond to Arizona mutual aid compact requests that are coordinated and approved by the division. Monies in the fund are continuously appropriated and are exempt from the provisions of § 35-190 relating to lapsing of appropriations. The department of emergency and military affairs shall administer the fund.
B. Monies in the fund shall be used for the costs incurred by this state while assisting other states with emergencies or natural disasters pursuant to § 26-402 or to reimburse supporting partners of this state and agencies in this state that respond to Arizona mutual aid compact requests that are coordinated and approved by the division.
C. For the purposes of this section:
1. “Arizona mutual aid compact” means a compact entered into pursuant to § 26-402.
2. “Division” means the division of emergency management within the department of emergency and military affairs.
3. “Supporting partner” includes any county, city, town, private water or wastewater utility, special taxing district or federally recognized Indian tribe that has a fully executed Arizona mutual aid compact agreement.
