A. In any case in which the payment or denial of benefits will be determined by § 23-777, the deputy shall proceed as provided in § 23-773. His examination of the case may be by investigation or by affording the parties reasonable opportunity for a fair hearing.
B. The determination of the deputy thereupon shall be treated for all purposes as any other determination of a deputy made pursuant to § 23-773, except that a timely appeal therefrom is removed to the appeals board.
C. If the determination appealed from was based on a fair hearing, the hearing officer may make his recommendation and the appeals board may make its decision on the basis of the evidence previously submitted.
