A. The capital improvement fund is established and shall be held and administered by a fiscal agent designated by the commission pursuant to § 17-290.
B. Monies in the capital improvement fund may be expended by the department, subject to legislative appropriation for:
1. Constructing game and fish facilities.
2. Acquiring, converting, renovating or improving existing facilities for game and fish facilities.
3. Acquiring real property for game and fish facilities.
4. Expenses of the commission incident to and reasonable and necessary to carry out the purposes of this subsection.
C. If at any time the monies in the conservation development fund are insufficient or the commission reasonably expects these monies to become insufficient for the distributions required in § 17-288, monies in the capital improvement fund not otherwise committed shall be transferred by the fiscal agent to the conservation development fund until the monies in the conservation development fund are sufficient to make the required distributions when due.
