A. The board of supervisors shall evaluate expressions of interest that are received and may award the operating agreement to a nonprofit corporation that is best qualified to perform the requirements of this chapter, except that the board of supervisors may agree to waive any organizational requirements prescribed by § 11-1405 for an existing nonprofit corporation that is otherwise qualified and that agrees to perform under and comply with the remaining provisions of this chapter.
B. If no qualified existing nonprofit corporation expresses an interest in entering into an operating agreement under this chapter, the board of supervisors may enter into an operating agreement under this chapter with a newly formed nonprofit corporation.
