As used in this subchapter:
(1) “Board” or “regional board” means a regional solid waste management board established pursuant to this subchapter;
(2) “Commission” means the Arkansas Pollution Control and Ecology Commission;
(3) “Disposal site” means any place at which solid waste is dumped, accepted, or disposed of for final disposition by landfilling, incinerating, composting, or any other method;
(4) “District” means a regional solid waste management district;
(5) “Interested party” means the Director of the Division of Environmental Quality or his or her designee, the board, the person making application to the board, or any person submitting written comments on an application within the public comment period;
(6) “Landfill” means a permitted landfill under the Arkansas Solid Waste Management Act, § 8-6-201 et seq.;
(7) “Materials in the recycling process” means ferrous and nonferrous metals diverted or removed from the solid waste stream so that they may be reused, as long as such materials are processed or handled using reasonably available processing equipment and control technology as determined by the director, taking cost into account, and a substantial amount of the materials are consistently utilized to manufacture a product which otherwise would have been produced using virgin material;
(8) “Post-use polymer” means the same as defined in § 8-6-203;
(9) “Recovered feedstock” means the same as defined in § 8-6-203;
(10) “Recyclable materials” or “recyclables” means those materials from the solid waste stream that can be recovered for reuse in present or reprocessed form;
(11) “Recyclable materials collection center” or “collection center” means a facility which receives or stores recyclable materials prior to timely transportation to material recovery facilities, markets for recycling, or disposal;
(12) “Recycling” means the systematic collection, sorting, decontaminating, and returning of waste materials to commerce as commodities for use or exchange;
(13) “Solid waste” means all putrescible and nonputrescible wastes in solid, semisolid, or liquid form, including, but not limited to, yard or food waste, waste glass, waste metals, waste plastics, wastepaper, waste paperboard, and all other solid and semisolid wastes resulting from industrial, commercial, agricultural, community, and residential activities, but does not include materials in the recycling process as defined in this section or post-use polymers and recovered feedstocks;
(14) “Solid waste management system” means the same as provided in § 8-6-203;
(15) “Source separation” means the act or process of removing a particular type of recyclable material from the solid waste stream at the point of generation or at a point under control of the generator for the purpose of collection and recycling; and
(16) “Yard waste” means grass clippings, leaves, and shrubbery trimmings.
