(a)(1) As used in this section, “labor organization” means a lawful organization that is composed of public school employees that exists for the purpose of dealing with employers concerning grievances, labor disputes, wages, rates of pay, hours of employment, or other terms and conditions of employment.
(2) “Labor organization” includes a:
(A) Labor union exempt from taxation under § 501(c)(5) of the Internal Revenue Code of 1986, 26 U.S.C. § 501(c)(5) as amended; and
(B) Professional employee association exempt from taxation under § 501(c)(6) of the Internal Revenue Code of 1986, 26 U.S.C. § 501(c)(6), as amended.
(b)(1) A public school employee may join or terminate membership in a labor organization at any time.
(2) A labor organization or an employer may not place a restriction on the time that a public school employee may join or terminate membership in a labor organization.
