(a) The Department of Agriculture shall have authority to destroy, or, at its discretion, cause to be treated with pesticides, volunteer or other noncommercial cotton and to establish procedures for the purchase and destruction of commercial cotton in eradication zones when the department deems such action necessary to effectuate the purposes of this subchapter.
(b)(1) No payment shall be made by the department to the owner or lessee for the destruction or injury of any cotton which was planted in an eradication zone after publication of notice as provided in this subchapter, or was otherwise handled in violation of this subchapter, or the rules adopted pursuant thereto.
(2) However, the department shall pay for losses resulting from the destruction of cotton which was planted in such zones before promulgation of such notice.
