(a) Any person who shall practice or attempt to practice veterinary medicine in this state without having been duly licensed in accordance with the provisions of this chapter shall be deemed guilty of a misdemeanor. Upon conviction, the person shall be fined in any sum of not less than fifty dollars ($50.00) nor more than two hundred fifty dollars ($250) for each and every offense or imprisoned for a term of not less than six (6) months nor more than one (1) year, or shall be both fined and imprisoned in the discretion of the court.
(b) Each day of the unlawful practice shall constitute a separate offense.
(c) One-half ( 1/2 ) of the sums assessed as fines under this chapter shall be paid into the general fund of the county wherein the fine is assessed, and one-half ( 1/2 ) of the sums assessed as fines under this chapter shall be deposited with the Director of the Arkansas Livestock and Poultry Commission and credited to the account of the Arkansas Livestock and Poultry Commission.
(d) The unlawful practice of veterinary medicine is declared to be a public nuisance.
(e) In addition to the penalties provided in this section, the commission may institute legal proceedings to enjoin the violation of the provisions of this chapter or the rules of the commission in any court of competent jurisdiction, and the court may grant a temporary or permanent injunction restraining the violation thereof.
