(a) If any constable receives from any person any bonds, bills, notes, or accounts for collection and gives his or her receipt therefor in his or her official capacity, and fails to pay to that person on demand the amount he or she may have collected, and fails to return the bonds, bills, notes, or accounts, if they have not been collected, the constable and his or her securities shall be responsible on his or her official bond for the amount of the bonds, bills, notes, or accounts not paid over or returned.
(b) No constable shall be responsible for any bond, bill, or note for which he or she may have given his or her receipts and on which suit may have been brought.
