New York Consolidated Laws, Transportation Law - TRA § 2. [Exercise of powers and performance of duties]

Metropolitan transportation authority shall exercise all the powers and perform all the duties conferred or imposed upon it pursuant to any provision of the foregoing compact in conformity with and pursuant to the provisions of title eleven of article five of the public authorities law, as amended, and all other laws of the state of New York governing or regulating its creation, existence and activities.  Subject to those limitations imposed upon the actions of the said authority by any contract entered into with an agency of the state of Connecticut pursuant to the provisions of the foregoing compact, those assets and rights which from time to time are employed in the continuation and improvement of the said service and, in the case of assets having a fixed location, which are located within the territorial boundaries of the state of New York shall be deemed in the aggregate to constitute a “railroad facility” and a “transportation facility” of the authority for all of the purposes of the said title eleven of article five of the public authorities law, as amended.  Notwithstanding the foregoing, the authority may operate and maintain a “railroad facility” or a “transportation facility” as defined in title eleven of article five of the public authorities law outside the territorial boundaries of the state of New York.  Without limitation of the foregoing, arrangements entered into by metropolitan transportation authority in the effectuation of the purposes of this act shall be deemed “joint-service arrangements” within the intendment of the said title eleven of article five of the public authorities law, as amended.
